Ford Argues Appeal before the First Court of Appeals and Wins Favorable Judgment Preserving Multi-Million Dollar Settlement
October 27, 2008On August 29, 2008, the First Court of Appeals upheld the trial court's denial of a plaintiff's motion for a new trial in a case involving exposure to silicon. The case arose when multiple plaintiffs sought to overturn an agreed judgment related to the settlement of their claim. Plaintiffs argued that their agreed judgment should be set aside as "void as against public policy" because their trial lawyers did not tell them that the settlement was allegedly an aggregate settlement.
Beck Redden's Troy Ford argued the appeal along with Jeffery C. Kubin of Gibbs & Bruns, LLP. Andrea Paterson, also with Beck Redden, assisted with the briefing.
