Victory in the Corpus Christi Court of Appeals
April 3, 2009On April 1, 2009, the Corpus Christi-Edinburg court of appeals issued a favorable decision in a mandamus involving arbitration law and class action procedure. The case (In re Nationwide Credit) was certified as a class action. After certification, the class representative signed an agreement promising to arbitrate all disputes in the AAA. Despite this promise to arbitrate, however, he continued filing motions in the trial court, such as a motion to have class notices sent out. The appellate court granted mandamus relief, forbidding him from proceeding with the class action. David Gunn and John Adcock wrote the mandamus briefing for the prevailing side, and David Gunn presented the oral argument.
