Victory in the Houston Court of Appeals

On May 14, 2009 the Houston (First) Court of Appeals issued a favorable decision in an appeal from a million-dollar judgment. The case (Chavez v. McNeely) involved a breach-of-contract claim that arose out of an agreed divorce decree. The plaintiff filed suit for breach of contract, based on his interpretation of the agreed decree. The trial court agreed with the plaintiff, but the Court of Appeals did not. The Court of Appeals overturned the judgment in its entirety. The appellate court unanimously agreed with Beck Redden's argument on the defendant’s behalf about the contract. Beck Redden did not handle the case at trial for the defendant but did handle the appeal. Beck Redden partner David Gunn wrote the briefing, with the assistance of associate Erin Huber.
