Victory in the Texas Court of Appeals

On June 12, 2009, the Thirteenth Court of Appeals issued a favorable decision in an appeal involving claims of water and soil contamination. The case (DBMS Investments, L.P. v. ExxonMobil Corp.) involved a tract of land in Flour Bluff, Texas, which is located in Nueces County. The owner of the land sued ExxonMobil on allegations that the company's predecessor contaminated it back in the 1980s, when there was a gas plant nearby. The trial court dismissed the case as too late. The Court of Appeals agreed. The work in the trial court was led by Corpus Christi attorney Patricia Canales-Bell, with Beck Redden being brought in as co-counsel on appeal. Beck Redden partner David Gunn worked on the briefing with his appellate colleague John Adcock, both in conjunction with the trial team.
