Victory in the Texas Supreme Court

On Nov. 20, 2009, the Texas Supreme Court issued a favorable decision in a class action appeal. The case (Exxon Mobil Corp. v. Gill) involved a statewide class and complaints about gasoline pricing practices. The trial court's decision to certify a class of dealers was affirmed by the Court of Appeals. However, that decision was reversed by the Texas Supreme Court and thrown out by a unanimous vote. The successful defense of the case was a collaborative effort between Beck Redden and the Chicago office of Kirkland & Ellis. Kirkland & Ellis partner Rick Godfrey argued the case in the trial court, and Beck Redden partner David Gunn argued the case in the Court of Appeals.
