BRS Wins Reversal of Legal Malpractice Judgment on Appeal

On December 14, 2010, the Houston Fourteenth Court of Appeals issued an opinion reversing a legal malpractice judgment of $2.9 million against our client, rendering judgment in his favor.  The appeal, Cooper v. Harris, arose from a legal malpractice suit alleging negligence in the handling of an employment discrimination suit against the plaintiff’s former employer.  The jury found for the plaintiff and awarded damages in excess of $2.9 million.  On appeal, the court of appeals held that there was no evidence to support the causation element of the plaintiff’s legal malpractice claim, reversing the entire $2.9 million judgment and rendering judgment for our client.  The appeal was handled by BRS appellate partner Russell Post and former BRS attorney William Peterson, now a law clerk for U.S. Supreme Court Justice Clarence Thomas, with the assistance of their appellate colleague Erin Huber
