Beck Redden Wins Airline Deregulation Act Appeal

On October 25, 2011, Beck, Redden & Secrest LLP secured a victory for a major American airline in an Airline Deregulation Act case before the Fourteenth Court of Appeals of Texas.

 

Plaintiffs had sued the airline in Harris County, Texas, pleading breach of contract and negligence causes of action.  Beck Redden attorney Jas Brar litigated the matter for the airline in the trial court, earning a complete victory on summary judgment. 

 

The plaintiffs appealed to the Court of Appeals, presenting questions about the scope of preemption under the Airline Deregulation Act.  In a unanimous opinion authored by Justice Charles Seymore, the Court of Appeals affirmed the judgment for Beck Redden’s client and held that the Act preempted all of the claims.  Jas Brar handled the appeal with the assistance of colleague Chad Flores.
